Legal basis

Processing of personal data is only lawful if the processing falls under one of the grounds established in the Regulation. Compare Software processes personal data on the basis of explicit consent given by the individual for the processing of these personal data.

With regard to the processing of personal data for (direct) marketing purposes, Compare Software takes the position that this processing is necessary for the legitimate interests of compare.software.

Purpose of processing

Performance of an agreement

If a visitor enters into an agreement with Compare Software, the personal data provided will be processed in order to properly fulfil the agreement. The agreement between Compare Software and the visitor consists of mediating between the visitor and software suppliers. In doing so, Compare Software will send the visitor an email with one or more software suppliers, who will — exclusively at the visitor's request — approach the visitor with information about the software they supply.

Compare Software will provide the contact details to a maximum of 7 software suppliers when performing the agreement. The visitor may therefore be contacted by a maximum of 7 suppliers.

Marketing

Contact information provided is used by Compare Software to approach the relevant person with information about the services provided by Compare Software. Data that Compare Software collects through your visit to the website is also used to approach these visitors with information about the services provided by Compare Software.

Product information

Compare Software will send a whitepaper upon request. The contact information provided will also be used to inform about newsworthy items relating to the services or products developed by compare.software.

To improve our services;

Compare Software processes (personal) data in order to improve its services. For this purpose, Compare Software uses data from which it can determine how you use the website and which pages you visit.

Data that Compare Software collects

Compare Software processes personal data that can be traced back to an individual, as well as data that cannot be directly traced to a person, such as company data. In addition, Compare Software processes anonymised information about the use and functioning of the website.

Data you provide:

If you complete a form on the website or otherwise provide personal data to get in touch with Compare Software, the personal data you provide — including your gender, name, email address, phone number, job title and address details — will be stored.

Personal data you provide is stored on a Compare Software server or on a third-party server. If personal data is stored on a third-party server, Compare Software ensures that a data processing agreement has been concluded with this third party.

Data that Compare Software collects through your visit to the website

Compare Software gains insight into the use of the website through the use of tracking pixels and cookies. Screen tracking enables Compare Software to improve the ease of use and user experience for the visitor.

Via the IP tracking software of Leadforensics, Compare Software determines which IP address the website visitor is using. Using this IP address, Compare Software is able — through the Leadforensics software — to obtain company information about the visitor. The data that Compare Software obtains through Leadforensics concerns exclusively the generic email address of a company, the company's website, the company name and location. It is necessary for Compare Software, in pursuit of its legitimate interests, to process this data obtained via the IP tracking software of Leadforensics, with the aim of using this data for direct marketing purposes.

How we process data

Compare Software uses the collected data to provide services, improve services or develop new services. In addition, Compare Software uses the data to comply with any legal obligations.

The data collected by Compare Software is never provided to third parties, unless the storage of the data takes place on third-party servers. Compare Software has concluded a data processing agreement with these third parties, in which they commit to adequately securing the data they process. The processors engaged by Compare Software are:

Outside of what is stated in this privacy statement, Compare Software will never provide personal data to third parties, unless you give explicit consent or unless Compare Software is required to do so by a court ruling or legal provision.

Software and/or cookies used

Compare Software uses (online) software and/or cookies to analyse the use of the website. The following (online) software and cookies are used:

Leadforensics

Via the IP tracking software of Leadforensics, Compare Software determines which IP address the website visitor is using. Using this IP address, Compare Software is able — through the Leadforensics software — to obtain company information about the visitor. The data that Compare Software obtains through Leadforensics concerns exclusively the generic email address of the company, the company's website, the company name and location.

Screen tracking

Compare Software gains insight into the use of the website through screen tracking via the software of Mouseflow (see: mouseflow.com/gdpr/) and VWO (see: vwo.com/platform/security-compliance/gdpr/). This enables Compare Software to improve the ease of use and user experience for the visitor. The information obtained about the use of the website can never be traced back to a natural person, as Mouseflow and VWO fully anonymise all data obtained.

Google Analytics

Compare Software uses Google Analytics software to gain insight into website traffic. Compare Software does not collect IP addresses via Google Analytics. The information collected by Google is anonymised as much as possible.

The data collected by Google Analytics is transferred to Google's servers in the United States. Google complies with the requirements of the Privacy Shield and therefore offers an adequate level of protection.

Compare Software makes use of the remarketing function in Google Analytics. By placing a cookie, Compare Software can show visitors to the website an advertisement at a later point in time in Google's display network. If you visit the Compare Software website, the number of advertisements shown via the remarketing function of Google Analytics is limited to a maximum of five ad impressions.

Security

Compare Software does everything in its power to adequately secure the personal data collected. Compare Software has taken both technical and organisational measures to achieve a sufficient level of security for this personal data, given the nature of the data being processed.

The Compare Software website is secured with an SSL certificate. All messages sent via the website are therefore transmitted to Compare Software in an encrypted manner.

Duration of storage

After 18 months, Compare Software will delete all personal data, unless the personal data is still deemed necessary for the performance of an agreement. Compare Software will also retain the data for longer if it has a compelling reason to do so, in which case Compare Software will inform the individual concerned.

Data that Compare Software obtains via screen tracking is stored on Compare Software's servers for 6 months and then automatically deleted.

Data that does not constitute personal data, such as company names, locations and websites, is stored for statistical purposes for an indefinite period. This data can never be traced back to a natural person.

Amendments to the privacy statement

Compare Software is entitled to make changes to this privacy statement at any time. If Compare Software proceeds to amend the privacy statement, you will be informed of this via compare.software.

Your rights

Below you can read what rights you have and how you can exercise these rights with respect to Compare Software. Data that Compare Software obtains via third parties does not fall under the rights mentioned below. With regard to personal data that third parties collect about you, you will need to exercise your rights directly with those third parties, except in cases where those third parties are to be considered processors.

Right to withdraw consent

If Compare Software has obtained your consent to process personal data, you have the right to withdraw that consent at any time.

Right of access and rectification

You have the right at any time to request access to the personal data collected about you. You also have the right to have the personal data processed by Compare Software corrected.

Right to erasure

You have the right to request Compare Software to delete all data collected about you. In principle, Compare Software must comply with this request. In certain cases, another (legal) interest may outweigh the right to erasure, at the discretion of compare.software.

Right to lodge a complaint

You have the right, if after raising a complaint you are unable to reach a resolution with Compare Software, to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). You can submit your complaint in writing to the following address:

Applicable law & other provisions

Any legal disputes arising as a result of this privacy statement will be submitted exclusively to the Dutch courts under the application of Dutch law.

If Compare Software is taken over by a third party or merges with a third party, your personal data may be disclosed to that party. That party thereby acquires the right to continue processing your personal data as agreed in this privacy statement.
